Brett Simon represents companies of all sizes and industries in personal injury cases and commercial disputes at all stages of litigation. Whether it’s a pre-suit investigation, a wrongful death claim, a breach of contract, a serious injury, or a consumer protection issue, Brett draws upon his broad base of litigation experience to efficiently reach a favorable resolution. Recognizing that litigation is a team effort, Brett works collaboratively with the other professionals on his team to develop the best strategy available. Brett also takes a pro-active approach to his clients’ goals by using amicus briefs in key appellate cases to encourage changes in precedent or new interpretations of law.

  • Successfully negotiated a walk-away settlement on behalf of a non-profit organization sued by a vendor
  • Obtained successful appellate affirmance of defense verdict in medical malpractice case, with the unanimous opinion issued only twelve days after oral argument
  • Obtained successful appellate affirmance of defense verdict in a breach of warranty case involving issues of first impression related to an insurance company’s subrogation rights
  • Obtained voluntary dismissal of client after a filing summary judgment motion in a case with multi-million-dollar exposure potential.

Western District of Texas provides insureds with "out" to skirt federal jurisdiction in COVID-19 business interruption coverage cases

10.20.20 | In Orsatti v. Allstate, the Western District of Texas remanded a COVID-19 business interruption coverage case back to state court, finding the lawsuit properly stated a cause of action against the individual claims adjuster. The adjuster, who was alleged to have failed to fully investigate the insured's business interruption claim before issuing a denial, was a citizen of the same state as the insured thereby depriving the federal court of subject matter jurisdiction.
