BSCR Obtains Summary Judgment For Employer on Age Discrimination Claim

Baker Sterchi Cowden & Rice attorneys obtained summary judgment for an employer on a claim of age discrimination under the Missouri Human Rights Act, which was removed from Jackson County, Missouri circuit court to the U.S. District Court for the Western District of Missouri. The court ruled in favor of the former employer of the 63 year old white male managerial employee, finding that plaintiff had not made a prima facie case that age was a contributing factor in the termination of the employee and that the performance and financial justifications for the termination were not pretextual.
