Baker Sterchi Obtains Defense Victory in Wrongful Death Case

Baker Sterchi, through significant motion practice, obtained dismissal of their client in a Missouri wrongful death case. The case involved the death of a woman who allegedly fell from a retaining wall onto adjacent private property. Multiple parties were sued, including the home inspector who inspected the property three months earlier to facilitate the sale.  Baker Sterchi moved to dismiss the home inspector on the grounds that he owed no legal duty to the decedent. After multiple court hearings, the trial court granted the motion to dismiss, finding that there was no legal duty owed because of a lack of privity between the decedent and the home inspector.
