Class Action
BSCR attorneys have successfully represented clients in a variety of matters involving class actions under Federal Rules of Civil Procedure 23 and the states’ equivalent rules. For example, we have extensive experience in class actions that have been certified in litigation involving mass tort claims, insurance coverage and commercial claims. Our attorneys are experienced in all aspects of class actions including:
· Employing a Rule 23(b)(2) class action in the settlement of a mass tort claim so as to preclude the power of individual class members to opt-out of the settlement
· Decertifying a class action that had been certified by the district court under Rule 23(b)(3)
· Providing notice to individual class members under Rule 23(c)
· Representing clients in the fairness hearing under Rule 23(d)
· Representing clients in the appeal of a district court’s order granting or denying class action certification under Rule 2(f)
· Representing clients in “collective action” litigation brought by the Age Discrimination in Employment Act
