Construction Contracts
We provide advice in all types of construction related contracts, including the negotiation and drafting of such contracts and associated commercial agreements, plus joint venture and partnering documents.

Project Monitoring
We assist our clients in properly documenting and responding to claims, identifying and preserving all costs associated with claims for extra work, claims resulting from delays or suspension of the work and claims resulting from termination whether for convenience or for cause.

Claim Preparation
We assist our clients in preparing or responding to formal requests for equitable adjustment arising during the project or at project completion.  This includes an analysis of pending and/or rejected change order requests, delay damages, additional equipment and manpower costs, extended job site overhead, extended home office overhead, escalation and loss of productivity.

Litigation, Arbitration and Mediation
We provide full and complete services, including recommendations as to appropriate expert testimony and cooperation and coordination with expert witnesses and other witnesses in matters involving litigation, arbitration or mediation of all facets of claims or disputes related to the construction industry.  In addition to actual trials, arbitrations or mediations, our attorneys have extensive experience in negotiating settlements of construction disputes.

Significant Cases
Some of the more significant cases handled by our attorneys include representation of the general contractor and the general contractor's excess liability carrier in the Hyatt disaster in Kansas City, Missouri.  We were also involved in litigation in the Circuit Court of Jackson County, Missouri in a case which is believed to have resulted in the first reported decision involving the right of a design professional to recover attorneys' fees and expenses under indemnity provisions in the AIA General Conditions where it was determined that the design professional had no liability or responsibility for the underlying claims.  We were also involved in a rather significant case in the United States District Court for the Eastern District of Missouri involving a coverage dispute for property damage at a public utility power generation plant caused by a subcontractor doing upgrade and repair.  We received a favorable decision under the Colorado River Doctrine that the general contractor was entitled to proceed on its claims against the insured as well as the coverage issues in the state court of Jackson County, Missouri which resulted in favorable settlement of the claims of the general contractor.
