Trucking

With a lion’s share of the country’s manufactured goods and raw materials being moved by truck, BSCR has developed a breadth of experience in managing and trying a wide variety of lawsuits and counseling clients on other matters arising in the trucking industry. Our attorneys have represented interstate and intrastate trucking companies whose presence is national, regional and local in scope.

Our attorneys are available to be present at the scene of a collision within hours to consult and provide legal and practical advice and direction regarding a company’s investigation and risk management efforts following major collisions.

Our attorneys have participated in the investigation of major tractor-trailer collisions beginning just a few hours after the accident and have thereafter managed and ultimately tried those cases to a conclusion. This provides a unique perspective and insight into loss prevention and risk management issues on which the firm advises and counsels its clients both before and after accidents occur.

Our representation of and experience in the design and manufacturing of commercial trucks, passenger vehicles, heavy construction and agricultural equipment, diesel engines, and other component parts of motor vehicles also gives us a unique perspective in representing trucking companies.

Our trucking attorneys have experience with electronic control modules (ECMs), sensing diagnostic modules (SDMs) and the retrieval, interpretation and application of data from these and other on-board recording devices in the analysis of accidents involving commercial trucks and other motor vehicles.

Our trucking attorneys have experience with: driver technique and response; vehicle maintenance; driver qualification, hiring, training, and termination; hours of service and log book compliance; drug and alcohol testing; loading and unloading; and various other aspects of the Federal Motor Carrier Safety Act.

While the bulk of our work in the trucking industry is focused on motor vehicle collisions involving severe or catastrophic injury and property damage, we have also handled a wide variety of legal issues arising out of the trucking-related work environment including discrimination, harassment, wrongful termination, insurance coverage, cargo loss, and transactional disputes between shippers, carriers, brokers, and others within the transcontinental cargo distribution system.

We recognize the trucking industry is an integral part of this country’s past and future, and we are committed to providing our clients with legal and practical experience to (a) prevent losses from occurring in the first instance where possible, (b) investigate collisions, accidents and other untoward incidents when they occur, and (c) advise, counsel and take the necessary action - including trying lawsuits to conclusion - in consultation with the client to limit or avoid liability and adverse economic consequences on their part.
