BSCR Attorneys Obtain Verdict in Favor of Clients in Breach of Contract Action 03/01/10
On February 10, 2010, J. Scott Kreamer and Sara Dick obtained a unanimous verdict in favor of their clients after a three week jury trial in the United States District Court for the Western District of Missouri The case involved a breach of contract action brought against the owner and the developer of an apartment complex development in Kansas City, MO. The plaintiff served as the general contractor for construction of the development and alleged the defendants had breached certain contractual obligations which justified walking off the project. Plaintiff sought damages in excess of $2,500,000. The owner asserted a counterclaim for breach of contract against plaintiff seeking recovery of its costs of completion and for liquidated damages after plaintiff refused to complete work on the project. The jury found in favor of the owner and the developer on plaintiff's claim for breach of contract and in favor of the owner on its counterclaim against plaintiff, awarding the owner $4,991,970.87 in damages.
