Summary Judgment obtained for Construction Manager


We obtained summary judgment in favor of a Construction Manager on a  University of Illinois project. Two electricians brought separate actions alleging damages for personal injuries sustained in an arc flash on the project.  The electricians alleged that the construction manager owed them a duty under section 414 of the restatement of torts, which confers a duty where the contractor entrusts work to another and controls the means and methods of that work.  The two suits were consolidated and we moved for summary judgment as to both on the basis that the construction manager neither selected the electrical contractor, nor controlled the work.  The court agreed on both bases, granting judgment in favor of our client.
